HOW DO I GET STARTED? Read through this FAQ. You can download the non-activated plugin and give it a try by clicking the "Download for..." buttons on this website. The plugin runs in trial mode with audio drop-outs unless activated. Tips/tricks and troubleshooting are at the bottom of this FAQ. License sales are final, so try it before buying it!
WHAT'S WITH THE HARDWARE OPTIONS ON THE DE-FEEDBACK PAGE? If you do not already have a suitable machine to run audio plugins for live sound reliably at low latency, we have some recommended options. However, we do not officially recommend running Transient Magnifier or any other plugins at the same time as De-Feedback on the same Option 1 or Option 2 computer, but this and other “regular” plugins can be run together on the same computer because they have a more normal CPU load. If you wish to run both De-Feedback and other plugin products at the same time, we recommend having a dedicated machine for De-Feedback (such as one of our recommended NUC computers) and another machine for everything else. However, the Waves Livebox can run both De-Feedback and other regular plugins together just fine. Note that our recommended NUC computers come preconfigured for the De-Feedback product at this time, but you can add Transient Magnifier to the Desktop, then reconfigure VST Host with only Transient Magnifier inserted, and save the configuration as a new performance. Then, you can switch performances to use either De-Feedback (alone) or other regular plugins. For more general information about using this plugin and our recommended hardware units, read through the FAQ for De-Feedback and watch the tutorial videos on YouTube, as much of the same information applies. Hardware sales adhere to the terms and conditions of each supplier. Cannot ship Option 1 or Option 2 computers to Russia or Ukraine, and cannot ship the Option 1 computer to India. Anybody anywhere can buy a license, and the computers ship globally within a few weeks if there are no supply chain issues at the moment.
WHAT IS THE LATEST VERSION OF THIS PLUGIN? Version 1.0.6 which you can verify in the plugin UI window > Show Menu > About. In VST Host specifically, click the "plugin edit" dial icon next to the blue info icon inside of the plugin instance box to open the UI window. Version history notes are at the bottom of this FAQ. Note that there are both Intel and Silicon versions, but you should try both and see which one works better on your machine regardless of which build you have.
WHICH IS BETTER, WINDOWS OR MAC? The plugin should perform well on both platforms. The Mac version is in "beta" mode because it is unsigned, which means there are extra security steps to get it to work, which you can find at the end of this FAQ.
WILL THE LICENSE WORK WITH BOTH MAC AND WINDOWS? Yes, the license is universal.
ARE WE WORKING ON LINUX, AAX OR OTHER FORMATS? Sell your Bitcoin, fund Alpha Labs, then maybe we will.
CAN I BUY THE LICENSE USING ANY DEVICE, EVEN MY PHONE? Yes, the license is just a set of numbers that appear on the screen at checkout, and are also emailed to you from Fastspring.
WHAT IS A PERPETUAL LICENSE? It lets you keep Version 1.x.x forever without having to periodically revalidate, but you should expect to only get access to free patches and sub-versions, not primary version upgrades.
HOW DO I ACTIVATE, AND WHAT IS THE LICENSE TIED TO? The license ties itself to your machine, combining certain hardware identifiers that are most likely to remain permanent over time. Before opening your DAW to activate the plugin, first make sure that you don't have any extra or temporary harddrives or other network devices or cards connected to the computer that are not a permanent part of the machine. Establish an internet connection, then open the DAW and activate the plugin by opening the UI window and clicking on Show Menu and then License Management. In VST Host specifically, click the "plugin edit" dial icon next to the blue info icon inside of the plugin instance box to open the UI window. Enter your credentials and click Activate. If any additional non-permanent hardware elements accidentally get included in the fingerprint for your machine license, this could cause problems for transfers/reactivations in the future if these hardware items come and go. We do not recommend running this plugin on virtual machines or copies of operating systems running on external portable drives, because their identifiers often shift over time. Before updating or reinstalling the OS or sending the computer in for physical repairs, deactivate the current license on the machine so that it can be successfully reactivated again at a later point. To deactivate, click Deactivate twice within one second. The license exists on your machine separately from the plugin and any DAW that you run, but can only be managed through the plugin UI. A lost or damaged machine generally means a permanently lost license, so be careful!
HOW MANY TIMES CAN I TRANSFER THE LICENSE TO ANOTHER MACHINE? There are no limits on the number of times that you can transfer licenses from machine to machine, even deactivating and reactivating the same machine.
IS THERE AN OFFLINE ACTIVATION/TRANSFER OPTION FOR MACHINES WITHOUT INTERNET? Yes, enter your license credentials, then click Activate three times and follow each of the prompts. For deactivations/transfers, click Deactivate twice within one second and follow the prompts. You'll need a USB key or other method of transferring text-based files between machines. Do not interrupt or cut short the activation or deactivation process or prematurely close the pop-up windows. Watch the YouTube video on this topic for De-Feedback, the process is the same for Transient Magnifier.
HOW DO I RUN PATCHES AND UPGRADES? To run a patch or upgrade, make sure the DAW is not open, delete the current plugin file and replace it with the new downloaded file in the same location, then reopen the DAW or restart your machine. You may need to rescan for plugins, and on Mac you may also need to first unquarantine the file, instructions for this are at the bottom of this FAQ. You may also want to download the latest VST Host folder by clicking the link below the intro video on this website and select the version associated with the recommended NUC hardware option you purchased through our site (Option 1 simply omits certain De-Feedback presets specific to Option 2 PRO capabilities), although be aware that this comes preconfigured for De-Feedback specifically as mentioned already. Make sure VST Host is not open, delete the current VST Host folder called "vsthostx64" from your Desktop and replace it with the new folder inside the downloaded .zip file also called "vsthostx64", then delete the .zip file. Open VST Host, and if it prompts you with a security warning, make sure you un-check the option to "Always ask before opening this file" and then run the program. Then, restart your machine to confirm that VST Host opens automatically after booting (a vsthost.exe shortcut is in the startup folder).
WHAT EXACTLY AM I BUYING? The plugin itself is fungible, it will operate on any machine in trial mode with periodic drops in audio without an active license. The paid license is tied to the specific machine you choose to run the plugin. The license is sold and emailed to you by Fastspring. Our recommended computer hardware options are offered and fulfilled through SNUC, and we recommend that you purchase a GEN4 Focusrite Scarlett audio interface and download/install the driver from our website. For the Option 1 computer, we recommend the Solo. For the Option 2 PRO computer, we recommend the 18i16. You can also purchase a different GEN4 or even GEN3 Focusrite Scarlett interface, or experiment with other digital connections, but custom setup and patching in VST Host may be required. GEN2 and older is not recommended. Be sure to watch the YouTube tutorial on how to configure VST Host in these ways.
WHAT HAPPENS WHEN I ORDER ONE OF THE RECOMMENDED NUC HARDWARE COMBO OPTIONS? After you correctly fill out the computer request form (including the billing address of your payment method, if different than the shipping address), you will receive an automatic confirmation email for a successful form submission, and SNUC will contact you within a few business days and then send a direct payment link with applicable tax and shipping costs included. Feel free to explore alternative shipping options with the SNUC representative. By default, they will assume you are using it only for De-Feedback, so if there is any confusion, you can explain that you are using it for Transient Magnifier. Note that the Option 1 machine will fit into a 1U rackspace. For the Option 2 PRO machine, you can specify whether you would like the version with the tall or short chassis (if available); they operate identically, but only the short version will fit into a 1U rackspace. By selecting "any" chassis, SNUC will send you whatever version is available first. After payment, you will receive a tiny computer in the mail. Then, you will also receive any associated Focusrite analog USB interfaces in the mail that you ordered through the Sweetwater link.
WHEN THE NUC HARDWARE COMBO ARRIVES, WHAT DO I DO? First, plug the interface into any of the computer USB ports (except the USB-C port on the Option 1 machine, it has been unreliable in some circumstances). Make sure that the USB cables are high quality data transfer cables (preferably the ones that came with the unit), not merely charging style cables. Make sure the interface is switched on (if applicable), then connect the computer power cable to the computer. Things will boot automatically if you have a GEN3 interface. For GEN4 interfaces, you will need to download and install Focusrite Control 2 from the Focusrite website, but then afterward, go download and install the specific driver from the "Download Support Files" area on our website. You'll need an HDMI screen and USB keyboard/mouse, and preferably an internet connection to get started. Download Transient Magnifier and place it on the Desktop. Do not have any extra or temporary harddrives or other network devices or cards connected to the computer when you go to activate the plugin (if you do, unplug them and restart VST Host) because these items may accidentally get included in the fingerprint for your machine license, and this could cause problems in the future if they come and go. Inside VST Host, drag the plugin into a new or empty environment, click on the "plugin edit" dial icon just to the right of the blue info icon inside any plugin instance box to open the UI window, and then choose Show Menu > License Management and activate your plugin with your credentials. Custom environment configuration patching will be required. The first time you run things, you need to open the Focusrite control app associated with your unit's generation and apply any updates to the interface firmware that are available while connected to the internet. Then also go to Settings > System > Sound > More Sound Settings and then go into the Properties of the Focusrite interface on both the Playback and Recording tabs and make sure the use of the device is "disabled" so that the computer itself doesn't send any alerts out that interface during use. Save the current environment setup as a new performance. Then you can disconnect and turn off your internet, restart the machine and run it offline after that. We recommend disabling the wifi/Bluetooth and disconnecting the Ethernet, screen and keyboard/mouse during normal usage not only to cut down on CPU load from graphics rendering and port traffic, but because basically all antivirus protection has also been turned off in order to prioritize audio processing. To power off, briefly press and release the power button (do not press and hold the power button, as this may lead to file corruption), but if the machine accidentally loses power, when it comes back on or when you plug it back in, it will auto boot and recall the last used plugin setup saved as a performance in the DAW. You can select a different performance from the list or create/save your own. Always make sure the interface is connected (and turned on, if applicable) before powering on the computer; if it gets unplugged or turned off during use, plug it back in and turn it back on, then restart VST Host or the machine itself. Sometimes if there is a very short power outage (less than two seconds), the unit will not auto boot properly again and will need to be manually rebooted; best practice is to have a battery backup power supply. We also have found that multiple abrupt power losses can corrupt the VST Host file or wipe it entirely. In this case, we recommend keeping a backup copy of the vsthostx64 folder in Downloads so you can quickly replace it if needed.

CAN I USE MY OWN COMPUTER HARDWARE TO RUN THIS PLUGIN? Sure, give it a try.
HOW MANY INSTANCES OF THE PLUGIN CAN I RUN ON MY COMPUTER? As many as your machine CPU will handle, given a certain buffer size.
WHAT HAPPENS IF I LOSE OR MESS UP MY PLUGIN? Download the latest version from our website and put it in the same place or folder it was before. If you have an active license, it’ll work fine again. Don’t change the file name or extension of the plugin, and don’t move or delete any of the folders or files that the plugin creates on your computer. Also, don't rename the computer or the account.
WHAT HAPPENS IF I LOSE OR MESS UP VST HOST? Download the latest version from our website in accordance with your hardware option. Make sure VST Host is not open, delete the current VST Host folder from your Desktop and replace it with the new folder inside the downloaded .zip file, then delete the .zip file. Open VST Host, and if it prompts you with a security warning, make sure you un-check the option to "Always ask before opening this file" and then run the program. Then, restart your machine to confirm that VST Host opens automatically after booting. Be aware that the performances are configured for Defeedback by default.
WHAT HAPPENS IF I MESS UP MY WHOLE NUC? Download the new image file and load onto the machine to reset it to factory settings. There is a YouTube video that explains how to do this.
CAN I HAVE MULTIPLE PLUGIN FILES OR VERSIONS ON MY MACHINE AT ONCE? Don't try it, because having multiple of this plugin of either the same or different version or sub-version on your machine at the same time could crash the plugin. We recommend deleting the current version from your machine before downloading or placing versions of any kind on that machine. We designed the licensing system to work with only one plugin on a machine at a time, and we don’t know what could happen when there are two or more. It might cause a black hole and destroy the universe, so don’t risk it.
DOES IT HAVE LATENCY? No, the plugin runs at zero latency. The only latency you need to worry about is the latency introduced by your computer and audio I/O method.
WHAT DOES THIS PLUGIN DO? It uses a sophisticated algorithm to identify parts of the signal that are most likely to be transient content and it boosts them by the selected decibel amounts, and tries to leave everything else under the sensitivity threshold unchanged.
HOW IS IT DIFFERENT THAN TECHNIQUES LIKE PARALLEL COMPRESSION OR DYNAMIC EXPANSION? Other methods of transient boosting alter the signal in ways that distort the original sound generally. Our algorithm sounds natural and intuitive, and leaves the non-transient parts of the signal untouched.
IS THE PLUGIN LINEAR PHASE? Yes and no. It is linear phase generally, but the boosted portions of the signal themselves may not be completely linear phase, but they're close... let's call it a minimum phase product.
IS IT FULL QUALITY? Yes, it can operate at all the normal sample rates from 44.1k to 96k with any bit depth allowed by the DAW.
IS IT MONO OR STEREO? It will be mono or stereo depending on how your DAW audio channel is configured.
WHAT CAN I USE IT ON? You can use it on drums and percussion, instruments generally, and even vocals. You can use it on individual channels or a submix of channels such as a drum bus.
WHY DO SOME OF THE SLIDERS TURN RED ABOVE THE HALFWAY POINT? With more extreme settings, it is possible to cause artifacts in the signal. The red ranges indicate that artifacts are possible, although they may not be audible in all cases depending on the content of the signal. Use your ears and decide what sounds best.
IS THERE ANYTHING I SHOULD BE CAREFUL ABOUT? Since the plugin essentially is in the business of boosting signal content, be aware that if audio feedback occurs on a channel with this plugin inserted, there is the potential for “runaway” feedback if the feedback itself triggers the boosting. We recommend putting a zero-attack hard limiter after this plugin and set the threshold to perhaps 5-10dB above peak signal content as a safety measure.
CAN I SELL MY LICENSE TO SOMEONE ELSE? Sure, but be aware that we only support our product up to two degrees of ownership transfer. This means that we support you and the next person you sell it to, but nobody after that. We also don't support renters, you are expected to be the line of support to renters if you rent out our products. Also note that it is against the Windows IoT Enterprise license agreement to make copies of the OS or disk.
CAN I SELL MY HARDWARE TO SOMEONE ELSE? Sure, but check the manufacturer's terms and conditions first.
DO WE HAVE DEALERS OR DISTRIBUTORSHIPS? Not at this time, but we do offer discounts on bulk license orders of ten or more.
DO WE HAVE EDUCATIONAL DISCOUNTS? Not at this time.

USING YAMAHA USB: To connect the computer to a Yamaha DM3 or DM7 console via USB, download the Yamaha Steinberg USB driver (pre-installed on our recommended NUC hardware options as of Jan 1, 2025) and select the Yamaha ASIO device in the DAW, then go to the ASIO control panel and set the mode to Standard and the latency to the lowest setting. On your Yamaha console, select the USB as the I/O. Make sure the console is on before the computer so that the DAW will automatically reconnect after a power cycle.
CAN I USE MIC AND/OR LINE LEVEL INPUTS ON THE RECOMMENDED OPTIONS? Yes, you can plug into either the XLR or the 1/4" inputs, then patch them accordingly in VST Host.
MAC VERSION DOESN'T SHOW UP. You need to "allow" it in Privacy & Security, and potentially also unquarantine it using the Terminal. Sometimes you need to attempt to open the file by right-clicking on it, just ignore the message about needing to select an application etc, go straight to Privacy & Security and click "allow" within 30 minutes. Visit the De-Feedback official user group on Facebook for additional information.
VST3 FILE SHOWS UP AS AN APPLICATION AND WON'T LOAD. Go to View Hidden Files or uncheck “Hide extensions for known file types” and see if the file extention says .vst3.exe and if so, delete the .exe part and try again.
TERRIBLE AUDIO DISTORTIONS FROM FOCUSRITE EVEN AFTER UPDATING FIRMWARE AND SUCH. Make sure your USB cable is a data transfer cable, not merely a charging cable, preferably the one that came with the original interface. Make sure you're using the recommended driver. If you're using your own machine, try increasing the latency (buffer size).
AUDIO SOUNDS A BIT LIKE A ROBOTIC TIN CAN. You likely have a parallel patch somewhere, make sure you aren't sending both an unprocessed and a processed version of the signal to the main output. On the Focusrite units, if applicable, make sure the "Direct" button is white, not green. As a test, mute the plugin and make sure all audio goes away; if not, there's a patching/routing problem.
ANYDESK HAS ADDRESS [1 811 905 542] OR [1 585 450 973], AND SOMETIMES DISCOVERS OTHER DE-FEEDBACK MACHINES. Click on hidden icons in lower right corner of screen, right click and close AnyDesk. Search Settings for "Add or Remove Programs" and uninstall AnyDesk. If desired, redownload and install AnyDesk.

This End User License Agreement (the “Agreement”) applies to the De-Feedback (the “Software”), provided by Alpha Labs LLC (“Alpha Labs”).
NOTICE TO PURCHASERS: Your purchase or download of the Software provides you with a license to use the Software under the terms of this Agreement - it is not a transfer of ownership. When you “buy” or “purchase” the Software, you are acquiring a license to use the Software according to these terms. The full terms and conditions of this license are detailed below.
By continuing to use the Software, you agree as follows:
1.1. You understand and intend that this Agreement is a legally binding agreement and the equivalent of a signed, written contract;
1.2. You will use the Software in accordance with applicable laws and regulations and in accordance with the terms and conditions in this Agreement as it may be amended by Alpha Labs from time to time; and
1.3. You understand, accept, and have received this Agreement and its terms and conditions, and acknowledge and demonstrate that you can access this Agreement.
If you do not agree with the terms and conditions in this Agreement, please discontinue all further use of the Software.
Upon purchase, Alpha Labs grants you a single, non-exclusive, and limited personal license to access and use the Software. This license is conditioned on your continued compliance with the terms and conditions in this Agreement. You may not copy, decompile, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Software, any updates, or any part thereof (except as and only to the extent that any foregoing restriction is prohibited by applicable law or to the extent as may be permitted by the licensing terms governing use of any open-sourced components included with the Software).
You may transfer your license to another user, but if you do so we will not offer technical support beyond the first transfer away from the original purchaser.
You understand that you may receive business-related communications from Alpha Labs through the Software or through email, such as product and other announcements, and administrative notices. You agree that these communications are not “unsolicited commercial email advertisements” and you agree to receive them.
Marketing-related email messages will be accompanied by instructions for opting out.
Alpha Labs may, in its sole discretion, provide you with customer and technical support services related to the Software (“Support Services”). Alpha Labs is not required to provide Support Services unless otherwise required by applicable law. No failure to provide, or to continue to provide, Support Services will be a default of Alpha Labs under this Agreement. Any supplemental software code provided to you as part of the Support Services will be treated as part of the Software, and as between you and Alpha Labs will be and remain the sole property of Alpha Labs and will be subject to the terms and conditions of this Agreement.
Alpha Labs customer support may be reached by contacting us at support@alphalabsaudio.com. You agree that you will look solely to Alpha Labs in connection with Support Services.
Alpha Labs reserves the right to modify or discontinue, temporarily or permanently, the Software (or any part of the Software) with or without notice at any time. You agree that Alpha Labs will not be liable to you or any third party for any modification, suspension, or discontinuance of the Software.
Alpha Labs reserves the right to monitor use of the Software to determine compliance with this Agreement, as well as the right to edit, refuse to post, or remove any Content, information, or materials, in whole or in part, at our sole discretion. We reserve the right to refuse access to the Software to anyone, or terminate any License, for any reason, at any time.
Electronic communications using the Software or the website may not always be encrypted. You acknowledge that there is a risk that data, including email, electronic communications, and personal data, may be accessed by unauthorized third parties when communicated between you and Alpha Labs or between you and other parties.
Alpha Labs and its affiliates and agents are permitted, but not obligated, to review or retain your communications.
The Software or our website may contain links to other sites and software applications, including through display advertisements (the “Linked Services”). Alpha Labs does not control the Linked Services, and Alpha Labs and its affiliates and agents make no representations whatsoever concerning the content, accuracy, security or privacy of those Linked Services. The fact that Alpha Labs has provided a link to an external location is not an endorsement, authorization, sponsorship, or affiliation with respect to such Linked Services, its owners, or its providers. There are risks in using any information, software, or products found on the Internet, and Alpha Labs cautions you to make sure you understand these risks before retrieving, using, relying upon, or purchasing anything via the Internet. The Software is owned by Alpha Labs and is protected by United States copyright laws and international treaty provisions. All Software content, trademarks, services marks, trade names, logos, and icons are proprietary to Alpha Labs or are used under license from a third party. Nothing contained in the Software should be seen as granting any license or right to use any trademark displayed in the Software without the written permission of Alpha Labs or such third party that may own the trademarks displayed in the Software. Your use of the trademarks displayed in the Software, or any other content in the Software, except as provided in this Agreement, is strictly prohibited.
Intellectual property displayed through the Software is either the property of, or used with permission by, Alpha Labs. You are prohibited from using or authorizing the use of this intellectual property unless specifically permitted under the Agreement. Any unauthorized use of this intellectual property may violate copyright laws, trademark laws, the laws of privacy and publicity, or other regulations and statutes.
Your use of the Software is entirely at your own risk.
The Software is provided by Alpha Labs on an as-is basis. Alpha Labs expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Alpha Labs makes no warranty that (i) the Software will meet your requirements, (ii) that operation of the Software will be uninterrupted, timely, secure, or error-free, or (iii) the results that may be obtained from the use of the Software will be accurate or reliable.
No advice or information, whether oral or written, obtained by you from Alpha Labs, or through the Software creates any warranty regarding the Software not expressly stated in this Agreement.
Because some states or jurisdictions do not allow the disclaimer of implied warranties, the foregoing disclaimer may not apply to you.
You expressly understand and agree that Alpha Labs is not liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including damages for loss of profits, goods, goodwill, use, data, or other intangible losses (even if Alpha Labs has been advised of the possibility of such damages), resulting from the use or the inability to use the Software or any other matter relating to the Software, and without regard to whether such damages, or claims of damages arise based in contract, tort or otherwise.
Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, the liability of Alpha Labs and its affiliates will be limited to the fullest extent permitted by law.
You agree to indemnify and hold Alpha Labs and its affiliates, officers, agents, and employees harmless from any claim, demand, loss, costs, or expense, including attorneys’ fees, made by any person or entity arising out of your violation of this Agreement, state or federal laws or regulations, or any other person’s rights, including infringement of any copyright or violation of any proprietary or privacy right. Under no circumstances will Alpha Labs or its affiliates or agents be liable for any damages of any kind that result from the use of, or the inability to use, the Software, including any liability based on Alpha Labs’s negligent acts.
Certain personal and other information that we collect, process, and share is subject to our Privacy Policy. As a condition of using the Software you agree to the terms of the Privacy Policy, as it may be changed from time to time. Our Privacy Policy, which is incorporated here by reference, is located at https://www.alphalabsaudio.com. You agree that your use of the Software is subject to the Privacy Policy.
Alpha Labs reserves the right to disclose any information, including personally identifiable information about you, as necessary to satisfy any applicable law, regulation, legal process, or governmental request. Alpha Labs reserves the right to fully cooperate with any law enforcement authorities or court order requesting or directing Alpha Labs to disclose the identity of any user believed to be in violation of this Agreement.
By accepting this Agreement, you waive all rights and agree to hold Alpha Labs harmless from any claims resulting from any action taken by Alpha Labs during or because of its investigations or from any actions taken as a consequence of investigations by either Alpha Labs or law enforcement authorities.
By using the Software, you represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
The Agreement, and all future agreements you enter into with Alpha Labs, unless otherwise indicated on such other agreement, will be governed by the laws of the State of Oregon. This is the case regardless of whether you reside or transact business with Alpha Labs, or any of its affiliates or agents, in the State of Oregon or elsewhere. Unless a dispute would be governed by the terms of Section 16 below, you agree to submit to the personal and exclusive jurisdiction of the courts located within the city of Salem, Oregon, United States.
For EU users only: In the event of a dispute relating to the interpretation, performance, or validity of this Agreement, an amicable solution can be sought before any legal action. You can file your complaint with Alpha Labs by sending a message via email to support@alphalabsaudio.com. In case of failure, you can, within one year of the failed request, have recourse to an Alternative Dispute Resolution procedure by filing an online complaint on the European Commission’s Online Dispute Resolution website: https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.chooseLanguage. If out-of-court dispute resolutions fail, the dispute may be brought before the competent courts.
THIS SECTION CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER. IT AFFECTS YOUR LEGAL RIGHTS. PLEASE READ IT CAREFULLY.
Any dispute or claim relating in any way to your use of the Software (each, a “Claim”) will be resolved by binding arbitration, rather than in court (except that you may assert claims in small-claims court if your claims qualify). You agree that each Claim must be brought individually.
YOU AND ALPHA LABS AGREE THAT (i) THERE IS NO RIGHT OR AUTHORITY FOR ANY DISPUTE TO BE ARBITRATED ON A CLASS ACTION BASIS OR TO UTILIZE CLASS ACTION PROCEDURES; (ii) THERE IS NO RIGHT OR AUTHORITY FOR ANY DISPUTE TO BE BROUGHT IN A PURPORTED REPRESENTATIVE CAPACITY OR AS A PRIVATE ATTORNEY GENERAL; AND (iii) NO ARBITRATION MAY BE JOINED WITH ANY OTHER ARBITRATION.
The Federal Arbitration Act and federal arbitration law apply to this Agreement and this binding arbitration clause.
The arbitrator will have the authority to decide all issues of arbitrability, including the scope and enforceability of this arbitration agreement. Any dispute will be resolved by binding arbitration pursuant to the JAMS Streamlined Arbitration Rules and Procedures, which are incorporated herein by reference and available at https://www.jamsadr.com/rules-streamlined-arbitration/.
Arbitration is a process with no judge or jury – an arbitrator will review the arguments in the dispute and award damages and other relief just like a court would. The arbitrator must follow this Agreement as a court otherwise would. Court review of the arbitration award is limited under the Federal Arbitration Act.
To start an arbitration, you must send an email to support@alphalabsaudio.com describing your Claim and requesting arbitration, or we may do the same by sending a written notice requesting arbitration to your address. The payment of the initial filing fees will be made by the party filing the Claim, and any other filing and other fees will be apportioned as directed by the JAMS rules. The arbitration will take place in Salem, OR, United States, unless the Parties agree to video, phone, or internet connection appearances.
Except as otherwise set forth below, you may seek any remedies available to you under federal, state or local laws in an arbitration action. As part of the arbitration, both you and Alpha Labs will have the opportunity for discovery of non-privileged information that is relevant to the Claim. The arbitrator will provide a written statement of the arbitrator’s decision regarding the Claim, the award given (including any attorneys’ fees and costs awarded), and the arbitrator’s findings and conclusions on which the arbitrator’s decision is based.
Notwithstanding the terms of this Section, either of us may bring a lawsuit in court for equitable relief, for any misuse or infringement of intellectual property rights, or for any Claim related to, or arising from, allegations of theft, piracy, invasion of privacy, or unauthorized use of the Software.
BY AGREEING TO THIS ARBITRATION PROVISION, YOU UNDERSTAND THAT YOU AND ALPHA LABS WAIVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL.
You and Alpha Labs agree that if any portion this Section is found illegal or unenforceable, that portion will be severed and the remainder of the Section will be given full force and effect.
17.1. Agreement Revisions. This Agreement may only be revised in writing by Alpha Labs, or by Alpha Labs’s publication of a new version on the Software.
17.2. Force Majeure. Alpha Labs is not liable for any delay or failure to perform resulting from causes outside the reasonable control of Alpha Labs, including without limitation any failure to perform hereunder due to unforeseen circumstances or cause beyond Alpha Labs’s control such as acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
17.3. No Partnership. You agree that no joint venture, partnership, employment, or agency relationship exists between you and Alpha Labs because of this Agreement or your use of the Software.
17.4. Assignment. Alpha Labs may assign this Agreement, in whole or in part, to any person or entity at any time with or without your consent. You may not assign the Agreement without Alpha Labs’s prior written consent, and any unauthorized assignment by you will be null and void.
17.5. Severability. If any part of this Agreement is determined to be void, invalid or unenforceable, then that portion will be severed, and the remainder of the Agreement will be given full force and effect.
17.6. Attorneys’ Fees. In the event any litigation is brought by either party in connection with this Agreement, the prevailing party in such litigation will be entitled to recover from the other party all the reasonable costs, attorneys’ fees and other expenses incurred by such prevailing party in the litigation.
17.7. No Waiver. Our failure to enforce any provision of this Agreement will in no way be construed to be a present or future waiver of such provision, nor in any way affect the right of any party to enforce every such provision thereafter. The express waiver by us of any provision, condition or requirement of this Agreement will not constitute a waiver of any future obligation to comply with such provision, condition or requirement.
17.8. Equitable Remedies. You hereby agree that Alpha Labs would be irreparably damaged if the terms of this Agreement were not specifically enforced, and therefore you agree that we will be entitled, without bond, other security, or proof of damages, to appropriate equitable remedies with respect to breaches of this Agreement, in addition to such other remedies as we may otherwise have available to us under applicable laws.
17.9. Entire Agreement. This Agreement, including the documents expressly incorporated by reference, constitutes the entire agreement between you and Alpha Labs with respect to the Software and supersedes all prior or contemporaneous communications, whether electronic, oral or written, between you and Alpha Labs with respect to the Software.

When you interact with us, such as when you reach out to us via our contact form, we collect certain contact information such as your email address and name.
When you make purchases or other transactions through our Service, we or our payment processor collect certain payment and transaction information, including your payment method (which is only collected by our payment processor), geographic region and purchase history. Please note that we do not store complete payment card information - this is handled by our secure payment processors. Our payment processor is Fastspring, and data that they collect is covered under their Privacy Policy.
When you enter a license key into the Service, the Service collects certain identifying information such as information on your hardware in order to verify your license with the Softwarekey server. No personally identifiable information is collected. After that verification period, the Service itself does not collect any information beyond storing its own settings.
We use this information to comply with financial regulations, handle purchases, maintain purchase records, manage refunds and disputes, prevent fraudulent activity, and process transactions and subscriptions.
Payment Processors: We share data with our third-party payment processors (we use Fastspring for payment processing) partners to comply with financial regulations, detect suspicious transactions, handle chargebacks, handle payment disputes, manage subscriptions, prevent credit card fraud, prevent fraudulent transactions, process international payments, process payments and transactions, process refunds, validate billing information, and verify payment methods.
Security Partners: We share data with certain security partners to host our services and store your data securely, prevent spam and abuse, manage databases and infrastructure, deliver content efficiently, manage user authentication, and provide content delivery services.
We only keep your personal data as long as it’s required to provide you with the Service. Sometimes a longer period might be required by law. After that, we will delete your personal data within a reasonable time.
